EdTrust is operated by EdTrust, with offices at Technopole El Ghazela, Raoued, Ariana, Tunisie, 2086. EdTrust provides a multi-platform suite of education technology tools to schools and education organisations worldwide.
These Terms of Service (“Terms”) govern access to and use of the Site at edtrust.io and any service that does not have its own dedicated agreement. Where a Customer has signed a separate Subscription Contract or Master Services Agreement with EdTrust, that contract takes precedence over these Terms in case of conflict, but only between EdTrust and that Customer; these Terms continue to apply to use of the public Site by visitors.
By using the Site or the Applications, you accept these Terms and our Privacy Policy.
These Terms may evolve over time. The date of the latest update is shown at the top of this page. Material changes are communicated by email or in-app notice. Continued use after changes take effect means you accept them. If you do not agree, you may stop using the Services.
EdTrust services are available on the web and on smartphones running Android or iOS. The minimum supported version is published on the Site and on the relevant app stores and may change over time. An Internet connection is required.
For Customers, access to the Services is granted only to authorised users defined by the Customer’s Subscription Contract. Customers are responsible for the actions of their users and for keeping credentials secure.
EdTrust may suspend or close an account at any time, in particular for breach of these Terms, breach of the Subscription Contract, non-payment, fraudulent use, or where required by law.
You agree not to:
Customer Data (including learner records, grades, attendance, payments) entered into the Services remains the property of the Customer. EdTrust acts as a data processor with respect to such data, in line with our Privacy Policy and Data Processing Agreement, and processes the data only on the Customer’s documented instructions.
All trademarks, logos, content, text, graphics, databases, source code and other resources accessible through the Site and the Applications are the exclusive property of EdTrust or its licensors, and are protected by international intellectual-property laws. EdTrust grants the Customer a non-exclusive, non-transferable, revocable licence to use the Services for the duration of the Subscription Contract and in accordance with these Terms. No other rights are granted by implication.
Any information you submit through public forms (demo requests, contact forms, quotation requests) is processed in accordance with our Privacy Policy. You confirm that the information is accurate and that you are entitled to share it.
The Site and Applications may include features powered by third parties (HubSpot, AWS, payment processors, SMS aggregators). Your use of those features is also subject to those providers’ terms and privacy policies. EdTrust is not responsible for third-party services that are integrated at your own request.
Except as expressly set out in a Subscription Contract, the Services are provided “as is” and “as available”. To the maximum extent permitted by applicable law, EdTrust disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the maximum extent permitted by applicable law, EdTrust shall not be liable for any indirect, incidental, special, punitive or consequential damages, loss of profits, loss of revenue, loss of data or business interruption, arising from your use of, or inability to use, the Services. EdTrust’s aggregate liability in connection with these Terms shall not exceed the fees paid by the Customer to EdTrust during the twelve (12) months preceding the event giving rise to the liability, unless a higher amount is provided in the Subscription Contract.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (for example, fraud, gross negligence, or willful misconduct).
The Customer shall defend and indemnify EdTrust against any third-party claim arising from (a) the Customer’s breach of these Terms, (b) the Customer’s misuse of the Services, or (c) the content uploaded by the Customer that infringes the rights of a third party.
Neither party shall be liable for delay or failure to perform caused by an event of force majeure, including natural disasters, political or social unrest, pandemic, war, embargo, strike, denial-of-service attacks, failure of telecommunications or cloud infrastructure beyond the party’s reasonable control. The affected party shall notify the other and resume performance as soon as reasonably possible.
Where the Customer is bound by a Subscription Contract, the governing law and dispute resolution clauses of that contract prevail. In the absence of such a contract, these Terms are governed by the laws of the country in which the EdTrust entity contracting with you is established, and disputes are subject to the exclusive jurisdiction of the competent courts at its registered office. Where required by applicable consumer law in your country, you retain the protection of mandatory provisions.
